CONSIDERATION OF ENVIRONMENTAL FACTORS
6.1
DUTY TO CONSIDER ENVIRONMENTAL IMPACT
Section 5.5 of the Act requires the determining authority to examine and consider to the fullest
extent possible all matters affecting or likely to affect the environment by reason of that activity.
The regulatory requirements for environmental impact assessment of activities are specified in
Section 5.6 of the Act. This section identifies the environmental impact assessment functions of a
determining authority in accordance with the EP&A Regulations.
Section 171 of the Regulation requires the determining authority to consider the environmental
factors specified in the environmental factors guidelines that apply to the activity when considering
likely impacts on the environment. The “Guidelines for Division 5.1 Assessments” published by the
Department of Planning and Environment which has been applied to the assessment of the proposed
activity in accordance with the section 171 requirements. The guidelines include reference to the
environmental factors for consideration in section 171(2) of the Regulation. These factors are
addressed in Table 3.

disturbance. Vegetation and surface impacts will be limited and

to carry out the works.
There is potential for noise, dust and sediment/erosion impacts
in the immediate surrounds during the activity. These will be
controlled and regulated to avoid or minimise unreasonable
impacts.

The activity will involve excavation and a minor level of
vegetation clearing to achieve the required road width. The
works take place on Council road reserve in an already
moderately disturbed environment.

Some minor but insignificant impact on the ecosystems of the
locality is expected. These impacts are primarily in a moderately
disturbed environment. The minor impacts expected will not
result in any significant disturbance or irreversible damage to the

Significant impacts expected are not envisaged. The proposed
activity and construction will have a minor aesthetic impact given
