It has been confirmed that an approval to destroy has been issued for this item (AHIP No. C0002506
dated 3/3/2017). Given the proposed activity footprint, impacts are not envisaged on any further
sites of Aboriginal cultural significance and the disturbance of culturally significant items is not
expected. Nonetheless, standard precautionary measures are to be implemented during works to
ensure regulatory procedures are followed in the event of unexpected finds, that works in the area
cease, authorities be notified and further directions be obtained before works recommence.
5.2.8
Protection of the Environment Operations Act 1997
The NSW Protection of the Environment Operations Act 1997 (POEO Act) aims to protect and reduce
degradation of the environment from development activities. The POEO Act examines issues such
as air and water pollution, waste management and noise. The POEO Act also prescribes, “scheduled
activities” in which a licence must be obtained from the Office of Environment and Heritage (OEH).
The proposed activity is not identified as a Scheduled Activity under Schedule 1 of the POEO Act and
therefore an Environment Protection Licence is not required for the proposed works.
5.2.9
Roads Act 1993
The Roads Act 1993 (Roads Act) provides for the classification of roads. It also provides for the
declaration of Roads and Maritime and other public authorities as roads authorities for both classified
and unclassified roads. It also regulates the carrying out of various activities in, on and over public
roads.
Consent to carry out works on an unclassified road is not required as per Schedule 2 Clause 5(1) of
the Roads Act. However, a Road Occupancy Permit would need to be obtained as necessary prior
to construction commencing.
