impacts of the proposed activity. The finding of the report provided the following conclusions on
heritage impacts.

The subject area is not considered to have its own heritage value and the heritage items
within the locality is unlikely to be impacted by the proposed works.
There will be some reduction in curtilage for both items, and some removal of nonsignificant fencing and vegetation from along Camden Valley Way’s road reserve.
There is the possibility of potential physical impacts to the southern structure within the
‘Yamba’ heritage item, but these can be avoided.
The proposed works will modify the visual landscape in and around the subject area,
but this is unlikely to cause negative impacts to the heritage value of nearby items or
the subject area.
Given the above findings, the proposed works are deemed to pose an acceptable risk to the heritage
value of the subject area and the identified heritage items and that the work proceed with caution.
It is recommended that the proposed works are carried out following the recommendation of the
SOHI. The SOHI forms part of this REF and is included in Appendix B.
5.2.6
Mine Subsidence Compensation Act 2017
The Mine Subsidence Compensation Act 2017 aims to regulate development in areas that were
previously undermined. The site of the proposed activity is not within a Mine Subsidence District and
is not subject to the provisions of this Act.
5.2.7
National Parks and Wildlife Act 1974 (NPW ACT)
The NPW Act regulates the control and management of all national parks, historic sites, nature
reserves, and Aboriginal areas (among others).
The aim of the Act is to conserve the natural and cultural heritage of NSW. Where works will disturb
Aboriginal objects, an Aboriginal Heritage Impact Permit (AHIP) is required.
The harming or desecrating of Aboriginal objects or places is an offence under Section 86 of the
National Parks and Wildlife Act 1979. Under Section 90, an Aboriginal heritage impact permit may
be issued in relation to a specified Aboriginal object, Aboriginal place, land, activity or person or
specified types or classes of Aboriginal objects, Aboriginal places, land, activities or persons.
As identified above, a search of the NSW National Parks and Wildlife’s Aboriginal Heritage and
Information Management Services (AHIMS) database was undertaken 27 June 2023. The search
revealed that potential Aboriginal sites are present within a 500-metre radius of the proposed activity
area (see Figure 12).
