5.2.4
Contaminated Land Management Act 1997
The Contaminated Land Management Act 1997 (CLM Act) establishes a process for investigating and
(where appropriate) remediating land that the EPA considers to be contaminated significantly enough
to require regulation under Division 2 of Part 3. Further assessment or remediation under the CLM
Act is not considered necessary in this regard. The activity area has not been declared as
significantly contaminated under the CLM Act. Should suspected contaminants be identified on the
site, an assessment will be carried out to determine if notification of the contamination under Section
60 of the CLM Act to the EPA is required. Any required remediation would be carried out in
accordance with the CLM Act.
The EPA database did not identify any order issued over the land under the Act.
5.2.5
Heritage Act 1977
The Heritage Act 1977 protects Non-Indigenous heritage and is administered by the NSW Heritage
Office. Under Section 139 of the Act, an excavation permit must be obtained for the excavation or
disturbance of a relic unless an exemption applies. Following a review of the State Heritage register
on 27 June 2023, it is noted that the proposed activity area does not contain heritage items or places
of State significance within a 500-metre radius.
The area of activity is adjacent to Lot 101 in DP1143373 165 and Lot 162 in DP1087243 which are
mapped as containing items of local heritage significance listed in the Camden Local Environmental
Plan 2010 (reference: item no I105 Yamba and item no I104 Rheinbergers Hill). Niche Environment
and Heritage were engaged to prepare a Statement of Heritage Impact (SOHI) to assess the heritage
